Terms of Service

x4Gamers • legal

1. Agreement & Definitions

These Terms of Service (“Terms”) are a binding agreement between you (“you”, “User”) and x4Gamers (“x4Gamers”, “we”, “us”) regarding your access to and use of our website, apps, APIs, and services (collectively, the “Service”).

  • Marketplace means listings and transactions for digital items such as game keys, accounts, in-game items/currency, coaching, and similar.
  • Hosting means server hosting services, provisioning, panel access, and related add-ons.
  • Digital Goods means keys/codes, account credentials, downloadable items, or other digital content delivered electronically.
  • Content means text, images, listings, reviews, messages, and other materials posted on the Service.

2. Eligibility & Accounts

You must be legally able to enter into a contract in your country to use the Service. If you are under the age of majority, you may use the Service only with consent and supervision of a parent/guardian.

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You must provide accurate information (including a valid email) and keep it up to date.
  • We may require verification (e.g., for fraud prevention, high-risk orders, hosting provisioning, or compliance).

3. Acceptable Use

You agree not to misuse the Service. In particular, you may not:

  • Engage in fraud, chargeback abuse, account takeovers, or payment manipulation.
  • Attempt to bypass security, scrape protected data, reverse engineer protected parts, or probe for vulnerabilities.
  • Use the Service for illegal activities, including distribution of stolen accounts/keys, malware, or unauthorized access.
  • Harass, threaten, doxx, or otherwise harm other users or staff.
  • Upload/submit Content that infringes intellectual property rights or violates platform rules.

4. Marketplace Rules (Keys, Items, Accounts, Coaching)

The Marketplace may include first-party products and third-party seller listings (if enabled). Listing availability, pricing, and delivery times may vary.

  • Digital delivery: Many products are delivered instantly or shortly after payment.
  • Risk / compatibility: You are responsible for checking region locks, platform compatibility, system requirements, and game bans/ToS of publishers.
  • Accounts: Buying/selling accounts may violate a game publisher’s rules. You accept that risk. We may restrict categories based on compliance and risk.
  • Coaching/services: Scheduling, availability, and performance can vary. We may provide dispute resolution rules where applicable.

5. Payments, Taxes, and Pricing

Prices are shown in the currency presented at checkout. Taxes/VAT may apply depending on your location and product type. Payment processing may be handled by third-party providers (e.g., Stripe).

  • We may cancel or limit orders to prevent fraud, abuse, or pricing errors.
  • You authorize us and our payment providers to charge your selected payment method.
  • Chargebacks or payment disputes may result in account restrictions and denial of future service.

6. Refunds, Returns & Chargebacks

Digital Goods are typically non-refundable once delivered, except where required by law or where the product is defective/not delivered. Hosting and services may have different refund rules depending on provisioning status.

  • Non-delivery / invalid: If a delivered key/code is invalid or not delivered, contact Support with order details. We may replace or refund after verification.
  • Account/products risk: Refunds may be denied if the issue results from external bans, publisher policy changes, or user error (e.g., redeemed key).
  • Chargebacks: Initiating a chargeback without first contacting Support may be considered abuse.

7. Hosting Terms (Provisioning, Use, Limits)

Hosting services may be provisioned after successful payment. Delivery time can vary (e.g., verification, capacity, maintenance). You are responsible for how you configure and use your server.

  • Provisioning: We may require a valid email and additional verification before activation.
  • Resource limits: CPU/RAM/Disk/network limits may apply per plan. Abuse (DDoS, crypto mining, botnets) is prohibited.
  • Backups: Unless explicitly included, backups are your responsibility. We strongly recommend maintaining your own backups.
  • Downtime: We aim for reliability, but maintenance and outages can occur. Credits/SLA (if any) may be described on the Hosting page or plan details.

8. User Content & Community

You retain ownership of Content you submit, but you grant us a non-exclusive license to host, display, and distribute it as needed to operate the Service. You are responsible for your Content and confirm you have rights to submit it.

  • We may remove Content that violates these Terms, laws, or community rules.
  • We may moderate chats, reviews, and listings to prevent abuse and fraud.

9. Intellectual Property

x4Gamers branding, UI, site design, and original content are protected by intellectual property laws. You may not copy, reproduce, or distribute them without permission, except as allowed by law.

Game titles and trademarks belong to their respective owners and are used for identification purposes only.

10. Suspension & Termination

We may suspend or terminate your access to the Service if we reasonably believe you violated these Terms, engaged in fraud, created excessive risk, or harmed other users/platform integrity.

  • We may restrict orders, listings, hosting access, or withdraw services for compliance and risk reasons.
  • Termination does not waive your obligation to pay outstanding fees.

11. Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, x4Gamers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses.

Our total liability for any claim related to the Service will not exceed the greater of (a) the amount you paid us for the relevant order/service in the 3 months before the event giving rise to the claim, or (b) €50, unless applicable law requires otherwise.

13. Indemnification

You agree to indemnify and hold harmless x4Gamers and its affiliates from claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your Content, or your violation of these Terms or applicable laws.

14. Disputes, Governing Law & Venue

If you have an issue, contact Support first and we will try to resolve it quickly. Governing law and venue depend on our entity and your consumer rights.

  • Consumer rights: Nothing in these Terms limits mandatory consumer protections that apply in your country.
